DECISION OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE ON PROCEDURE FOR EXPORT OF NATURAL GAS THROUGH DISTRIBUTING PIPES.

Article 1

In this Decision, natural gas export shall refer to natural gas export through distributing pipes from Indonesian Customs Area to outside Customs Area.

Article 2

Natural gas export through distributing pipes is obliged to be notified and registered by the exporters by using Export Declaration (PEB) to the Customs and Excise Service Office supervising the loading site of the relevant natural gas.

Article 3

(1) The exporters are obliged to specify data in the PEB completely and correctly including description of each element of data of natural gas export value in accordance with the term of payment they notify.

(2) Quantity used as measuring unit of natural gas specified in the PEB is BBTU (Billion British Thermal Unit).

(3) Natural gas export loading time is when the natural gas is passing through the measuring device at any measuring end point of natural gas before being exported.

Article 4

(1) Data of quantity and value of natural gas export specified in the PEB are estimate data of export for the period of 1 (one) month as from the PEB registration date.

(2) The quantity and value of natural gas export notified in the PEB as meant in paragraph (1) shall be corrected based on measurement results of export realization of the measuring devices as meant in article 3 paragraph (3).

(3) Correction of export realization data as meant in paragraph (2) shall be conducted by means of submitting BCF 3.05 documents not later than 3 (three) working days as from the expiry of period as meant in paragraph (1).

(4) Data of natural gas export realization that is used as a basis for filling in the BCF 3.05 documents shall be attached as an integral part of the BCF 3.05 documents.

(5) No administrative sanction shall be imposed to the difference of quantities and values of natural gas export as meant in paragraph (2) and paragraph (3).

Article 5

For purpose of monitoring and supervision and/or as necessary, the Directorate General of Customs and Excise can at any time conduct:

Article 6

Upon enforcement of this Decision, the Decision of Director General of Customs and Excise No. KEP-49/BC/2004 dated July 9, 2004 on Procedure For Export Of Natural Gas Through Distributing Pipes is declared null and void.

Article 7

This Decision comes into full force and effect from September 1, 2004.

For public cognizance, this Decision shall be announced by placing it in the State Gazette of the Republic of Indonesia.
